52<ol type="a">
53<li><strong>"Collective Work"</strong> means a work, such
54as a periodical issue, anthology or encyclopedia, in
55which the Work in its entirety in unmodified form, along
56with one or more other contributions, constituting
57separate and independent works in themselves, are
58assembled into a collective whole. A work that
59constitutes a Collective Work will not be considered a
60Derivative Work (as defined below) for the purposes of
61this License.</li>
62<li><strong>"Derivative Work"</strong> means a work based
63upon the Work or upon the Work and other pre-existing
64works, such as a translation, musical arrangement,
65dramatization, fictionalization, motion picture version,
66sound recording, art reproduction, abridgment,
67condensation, or any other form in which the Work may be
68recast, transformed, or adapted, except that a work that
69constitutes a Collective Work will not be considered a
70Derivative Work for the purpose of this License. For the
71avoidance of doubt, where the Work is a musical
72composition or sound recording, the synchronization of
73the Work in timed-relation with a moving image
74("synching") will be considered a Derivative Work for the
75purpose of this License.</li>

77individuals, entity or entities that offers the Work
78under the terms of this License.</li>
79<li><strong>"Original Author"</strong> means the

89permission from the Licensor to exercise rights under
90this License despite a previous violation.</li>
91</ol>
92<p><strong>2. Fair Use Rights.</strong> Nothing in this
93license is intended to reduce, limit, or restrict any
94rights arising from fair use, first sale or other
95limitations on the exclusive rights of the copyright owner
96under copyright law or other applicable laws.</p>
97<p><strong>3. License Grant.</strong> Subject to the terms
98and conditions of this License, Licensor hereby grants You

100the duration of the applicable copyright) license to
101exercise the rights in the Work as stated below:</p>

103<li>to reproduce the Work, to incorporate the Work into
104one or more Collective Works, and to reproduce the Work
105as incorporated in the Collective Works;</li>
106<li>to create and reproduce Derivative Works provided
107that any such Derivative Work, including any translation
108in any medium, takes reasonable steps to clearly label,
109demarcate or otherwise identify that changes were made to
110the original Work. For example, a translation could be
111marked "The original work was translated from English to
112Spanish," or a modification could indicate "The original
113work has been modified.";;</li>

159are hereby reserved.</p>
160<p><strong>4. Restrictions.</strong> The license granted in
161Section 3 above is expressly made subject to and limited by
162the following restrictions:</p>
163<ol type="a">
164<li>You may distribute, publicly display, publicly
165perform, or publicly digitally perform the Work only
166under the terms of this License, and You must include a
167copy of, or the Uniform Resource Identifier for, this
168License with every copy or phonorecord of the Work You
169distribute, publicly display, publicly perform, or
170publicly digitally perform. You may not offer or impose
171any terms on the Work that restrict the terms of this
172License or the ability of a recipient of the Work to
173exercise the rights granted to that recipient under the
174terms of the License. You may not sublicense the Work.
175You must keep intact all notices that refer to this
176License and to the disclaimer of warranties. When You
177distribute, publicly display, publicly perform, or
178publicly digitally perform the Work, You may not impose
179any technological measures on the Work that restrict the
180ability of a recipient of the Work from You to exercise
181the rights granted to that recipient under the terms of
182the License. This Section 4(a) applies to the Work as
183incorporated in a Collective Work, but this does not
184require the Collective Work apart from the Work itself to
185be made subject to the terms of this License. If You
186create a Collective Work, upon notice from any Licensor
187You must, to the extent practicable, remove from the
188Collective Work any credit as required by Section 4(b),
189as requested. If You create a Derivative Work, upon
190notice from any Licensor You must, to the extent
191practicable, remove from the Derivative Work any credit
192as required by Section 4(b), as requested.</li>
193<li>If You distribute, publicly display, publicly
194perform, or publicly digitally perform the Work (as
195defined in Section 1 above) or any Derivative Works (as
196defined in Section 1 above) or Collective Works (as
197defined in Section 1 above), You must, unless a request
198has been made pursuant to Section 4(a), keep intact all
199copyright notices for the Work and provide, reasonable to
200the medium or means You are utilizing: (i) the name of
201the Original Author (or pseudonym, if applicable) if
202supplied, and/or (ii) if the Original Author and/or
203Licensor designate another party or parties (e.g. a
204sponsor institute, publishing entity, journal) for
205attribution ("Attribution Parties") in Licensor's
206copyright notice, terms of service or by other reasonable
207means, the name of such party or parties; the title of
208the Work if supplied; to the extent reasonably
209practicable, the Uniform Resource Identifier, if any,
210that Licensor specifies to be associated with the Work,
211unless such URI does not refer to the copyright notice or
212licensing information for the Work; and, consistent with
213Section 3(b) in the case of a Derivative Work, a credit
214identifying the use of the Work in the Derivative Work
215(e.g., "French translation of the Work by Original
216Author," or "Screenplay based on original Work by
217Original Author"). The credit required by this Section
2184(b) may be implemented in any reasonable manner;
219provided, however, that in the case of a Derivative Work
220or Collective Work, at a minimum such credit will appear,
221if a credit for all contributing authors of the
222Derivative Work or Collective Work appears, then as part
223of these credits and in a manner at least as prominent as
224the credits for the other contributing authors. For the
225avoidance of doubt, You may only use the credit required
226by this Section for the purpose of attribution in the
227manner set out above and, by exercising Your rights under
228this License, You may not implicitly or explicitly assert
229or imply any connection with, sponsorship or endorsement
230by the Original Author, Licensor and/or Attribution
231Parties, as appropriate, of You or Your use of the Work,
232without the separate, express prior written permission of
233the Original Author, Licensor and/or Attribution
234Parties.</li>
235</ol>
236<p><strong>5. Representations, Warranties and
237Disclaimer</strong></p>
238<p>UNLESS OTHERWISE MUTUALLY AGREED TO BY THE PARTIES IN
239WRITING, LICENSOR OFFERS THE WORK AS-IS AND ONLY TO THE
240EXTENT OF ANY RIGHTS HELD IN THE LICENSED WORK BY THE
241LICENSOR. THE LICENSOR MAKES NO REPRESENTATIONS OR
242WARRANTIES OF ANY KIND CONCERNING THE WORK, EXPRESS,

249EXCLUSION OF IMPLIED WARRANTIES, SO SUCH EXCLUSION MAY NOT
250APPLY TO YOU.</p>
251<p><strong>6. Limitation on Liability.</strong> EXCEPT TO
252THE EXTENT REQUIRED BY APPLICABLE LAW, IN NO EVENT WILL
253LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY
254SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY
255DAMAGES ARISING OUT OF THIS LICENSE OR THE USE OF THE WORK,
256EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF
257SUCH DAMAGES.</p>
258<p><strong>7. Termination</strong></p>
259<ol type="a">
260<li>This License and the rights granted hereunder will
261terminate automatically upon any breach by You of the
262terms of this License. Individuals or entities who have
263received Derivative Works (as defined in Section 1 above)
264or Collective Works (as defined in Section 1 above) from
265You under this License, however, will not have their
266licenses terminated provided such individuals or entities
267remain in full compliance with those licenses. Sections
2681, 2, 5, 6, 7, and 8 will survive any termination of this
269License.</li>
270<li>Subject to the above terms and conditions, the
271license granted here is perpetual (for the duration of
272the applicable copyright in the Work). Notwithstanding
273the above, Licensor reserves the right to release the
274Work under different license terms or to stop
275distributing the Work at any time; provided, however that
276any such election will not serve to withdraw this License
277(or any other license that has been, or is required to
278be, granted under the terms of this License), and this
279License will continue in full force and effect unless
280terminated as stated above.</li>

288the same terms and conditions as the license granted to
